WHY REGISTER A TRADEMARK?

As we have previously said, trademark rights emanate primarily from use. Indeed a manufacturer or merchant can establish rights in a mark through use and can sue a competitor for common law trademark infringement without ever having registered his mark. This naturally raises the question of "why bother with registration?" The answer is that although all rights arise primarily from use of the mark, registration strengthens those rights and makes them more enforceable against an infringing competitor.
